Attorneys Seana Willing (Chief Disciplinary Counsel for the State Bar of Texas) and Brad Johnson (Executive Director of the Texas Center for Legal Ethics) join Trish McAllister (Attorney for the Law Practice Management Department) to discuss ethics-related AI questions, including:
- What, if any, are the requirements for disclosure to clients and others that the practitioner is using AI?
- What is the bare minimum AI use that I need to remain compliant to be considered "up-to-date" on the latest technology?
- What ethics opinions have been published related to AI?
- Is AI better than calling the SBOT Ethics Helpline? Please give a comparison.
- Hundreds of lawyers and firms nationwide have been sanctioned for misuse of AI. Lawyers are supposed to be risk-averse. Why does this keep happening?
- Can you discuss whether AI chats or AI commercial software interactions by clients to conduct legal research are protected by the attorney-client privilege or the work-product privilege?
